Is the Breakup agreement right for my situation?

The Breakup agreement is designed for couples who have separated but can still communicate and want to maintain an amicable relationship.

To help decide whether the Breakup agreement is right for you please answer the following questions:

  • Have you and your ex been married for more than 3 years or lived together for more than 3 years?
  • Do you have assets (including cash assets)?
  • Are the assets owned by you or your ex in your own names or your joint names?
  • Are the assets owned by you or your ex in your own names or your joint names?
  • Are you intending to divide your assets equally between you?
If you answered yes to all of these questions then the Breakup Agreement is [probably] right for you.

The Breakup Agreement is not suitable in the following situations:

  • If you have been married or living together for less than 3 years. If this applies to you then you should seek legal advice regarding the division of your assets as different rules apply as to how your assets will be divided.
  • If any of your assets are owned by a Trust.  If you have assets which are in a Trust then you should seek legal advice as these assets may be treated differently.
  • If your assets include business assets. If you have business assets (including shares in a privately held company) then you should seek legal advice.
  • If you are not intending to divide your assets equally between you then you should seek legal advice.
  • If you have any assets which are outside of New Zealand.

Why do I need to send the Breakup Agreement to a lawyer?

It is a legal requirement that both parties to a relationship property agreement receive independent legal advice and that the lawyer certifies the agreement is meeting the legal requirements. This is to ensure that the Relationship Property Agreements are fair to both parties.

What happens if we don’t get independent legal advice?

If both parties to the Breakup agreement do not get independent legal advice and have the agreement certified by a lawyer then it will not be legally binding and either party could re-visit the relationship property division in the future.

Why do we have to upload relevant documents?

Your lawyer may suggest changes or variations to the agreement as they think necessary to meet your particular circumstances. This is an important part of ensuring that your agreement is legally enforceable. Our agreement is designed so that it can be changed by your lawyer, if required. .

Can my lawyer refuse to certify the agreement?

Yes. Lawyers have legal and ethical obligations that they must comply with. In the unlikely event that a lawyer refuses to certify your agreement please contact us and we will refund your fee. .
